You will then be provided with a report which will tell if your agreement is considered to be enforceable or unenforeable along with the chances of success if you wish to proceed with a claim to have the debt declared legally unenforceable. If you have payment protection insurance we will tell if we consider it to have been mis-sold to you which could result in you making a claim for all your payments to be paid back to you

If following an audit the legal opinion is your agreement does contravene the 1974 Consumer Credit Act you may not have to pay the outstanding balance.

Under the Consumer Credit Act 1974 any Credit Agreement MUST contain certain prescribed terms and conditions in order to make the agreement fair and legal.

Many Banks and Lenders have not complied with these regulations.

If your Credit Agreement does not comply with the requirements of the 1974 Consumer Credit Act it may be possible that the debt cannot be legally enforced and the consumer may seek a declaration of unenforceability from the lender.

This can potentially save you thousands of pounds.

This applies to agreements taken out prior to April 2007 which are for less than £25,000.
